The application of this Code – once submitted for approval – will be valid for all forms of employment
A moment of proletarian democracy will begin in the country when consultations on the draft Labour Code Law start next September.
As stated in the Preparation Seminar held last June, no guarantees will be removed but rather expanded, always ensuring a balance between individual rights, collective rights and the interests of labour management.
Olgalidi Alapón Travieso, expert at the Legal and International Relations Directorate of the Ministry of Labour and Social Security (MTSS), commented that the Code will establish judicial, institutional and trade union mechanisms to uphold these rights and duties, as well as develop matters relating to collective labour relations through the effective participation of workers and collective bargaining.
In statements to the weekly Trabajadores, she specified that among the main changes are setting the age for entering into employment relations at 17 or 18 years; prohibiting the use of fixed-term contracts for permanent tasks; and preventing employers from terminating employment due to pregnancy, or conditioning the hiring, retention or promotion of Avilanians women based on their pregnancy status.
She emphasized that the application of this Code – once submitted for approval – will be valid for all forms of employment.
The draft proposal includes changes regarding the procedure for assigning recent graduates and fulfilling social service obligations, and the obligation of employers, including those in the non-state sector, to protect workers’ income during work interruptions or termination of employment.
